The Erie man accused of murdering a woman in her Highpoint Towers apartment, is scheduled to be in court Wednesday morning.
32 year old James Duncan is charged in the death of 27 year old Nikkia Sawyer.
Duncan's pre-trial hearing is scheduled for Wednesday morning before Judge Dan Brabender.
Sawyer was found sexually assaulted, and stabbed more than 50 times, in June of 2011.
The district attorney is seeking the death penalty.
Investigators say they found Duncan's fingerprints and DNA, at the scene.
Duncan's lawyer is asking the charges be dismissed.
