The death penalty will stand for the man accused of a brutal 2011 Erie murder.
James Duncan is accused of stabbing Nikkia Sawyer some 60 times in her Highpoint Towers Apartment in Erie.
She was found bound and gagged in her bed. Prosecutors say torture, attempted rape, and other felonies merit the death penalty in this case. Duncan's attorneys say those factors should be thrown out.
Judge Daniel Brabender rejected that motion today in court. The trial should get underway in July.
