A majority of the 28 customers on a criminal complaint testified in court today, that Deniziak Siding took down payments, some thousands of dollars but did not perform the work.
Fifty-year old Martin Deniziak faces charges of theft and receiving stolen property as a result.
The customers went on the stand one-by-one with similar stories, of signing a contract for home repair work, paying up to half the total job cost as a down payment, then becoming frustrated making phone calls and asking for appointments only to have the work go undone.
Karen McGill testified to paying 5100 dollars as 50% down payment for a siding job for her Waterford Township home. Karen and her husband took out another mortgage to complete the work.
"We have half the money left but that will never cover the job," she told us. "It's just devastating, just awful."
Defense attorney Phil Friedman says that case doesn't belong in criminal court.
"This is civil (court case) not criminal," he told us. "This is about a business that went under."
The case now moves on to court or perhaps plea negotiations.
