Daneri: Shooting During Home Invasion "Justified"

District Attorney Jack Daneri has decided that an Erie man who shot and killed a suspected robber during a home invasion, did not commit a crime.

"At the time that he fired the shots it was reasonable for him to believe that he and others in the room were in danger of death or serious bodily injury," Daneri said at a press conference on Wednesday. 

On October 14th, 18-year- old Devonte Duck and 26- year- old Chahon Gilmore broke into a home at 119 West 21st Street.

One of the four people inside shot both men, killing Duck.

But evidence collected by the Erie Police Department proves he's justified in his actions, and no charges will be filed.

"We reviewed the calls to the 911 center and we also sat the men that did the shooting down at the Erie Police Department to do an extensive interview," said Erie Chief of Police Randy Bowers. They provided a video of the interviews to the District Attorney's office.

Police said the masked robbers allegedly pointed a gun at the people inside the house, making them fear for their lives.

"Because he had indicated... that one or more of these had a weapon that was pointed at the individuals, they were masked, they came in in a forceful manner, under all those circumstances he's within his right to use deadly force upon them," said Daneri.

Erie police have put together the puzzle of what happened inside the home the night of October 14th, but one piece is still missing.

Police have heard conflicting reports on whether a third suspect broke into the home that night. Right now that's still under investigation.
