The Pennsylvania Supreme Court will not review the case of a 13-year old girl struck and killed while trying to board her school bus.
That decision means that charges can proceed against the driver, Tyler Festa.

A local judge ruled that Festa was not criminally liable for the accident, a decision overturned by a higher court.
The Supreme Court ruling means that decision stands, and prosecutors can move forward with a preliminary hearing, which will likely be in February.
