The case against the Erie man charged with the shooting death of another man in east Erie, is being pushed back.
On Friday afternoon, 61-year-old Kenneth Ellis was is in court for his preliminary hearing. But after a brief meeting, Judge Joseph Lefaiver granted the Erie County District Attorney's office a continuance on the hearing.
Ellis is charged in last December's shooting death of 37-year-old Stevenson Jordan. Erie police say it happened after an altercation between the two men, in the area of East 23rd and German Streets.
Defense attorney Bruce Sandmeyer said that he was surprised by the request.
"We're going to look at all the reports we've received so far, see if we need to look at any potential expert witnesses for ourselves," said Sandmeyer. "But really, we need to go forward with this and see what evidence the Commonwealth has."
The case is expected to resume in April.
