All Charges Bound Over To Trial In Erie Homicide Case

The Erie man, charged in the shooting death of another man in December, is heading to trial.

Wednesday's preliminary hearing was postponed twice before, once because the key witness didn't show up.

But, because of a court order she did show on Wednesday, but her testimony didn't match what she originally told police.

Regardless, after the hearing,  a judge bound over all charges against 60-year old Kenneth Ellis, also known as "Stitches."
Ellis is charged in last December's shooting death of 37-year old Stevenson Jordan, near 23rd and German streets.

Hours after the shooting, a woman told police that Jordan's dying declaration while on the stretcher was "I can't believe Stitches shot me."
But during Wednesday's preliminary hearing, that key witnesses said she lied to police.
So, prosecutors played that videotaped statement to police during the hearing, but she maintained it was all a lie.

"The commonwealth's evidence is very very slim in this case," said Defense Attorney Bruce Sandmeyer. "We have a witness that's recanting, there were numerous people who were at the scene the crime scene who did not hear this dying declaration, and this was the only person who  supposedly hearing it and she's recanting today," Sandmeyer added.

Also in question was evidence recovered from Ellis' clothes on the night of his arrest.
Forensic experts found that there was gunshot residue on his T-shirt and jeans, but the defense is questioning those findings as well.

Those are all arguments that will come up during trial, or any pre-trial hearings. But for now, the case is moving forward.
