The embezzlement case against David Earls, the former business manager of St. Peter Cathedral Center School is going forward, but we've confirmed that his wife is no longer a defendant.
According to District Attorney Jack Daneri, the charges against 63-year-old David Earls for allegedly embezzling more than $169,000 from the school have been waived over to court.
Investigators say he gave himself raises and extra paychecks at the same time the Cathedral Center School fell behind in remitting employee withholding taxes.
Earls, who now lives in Maine, is expected to appear in court in may to enter a a plea.
The DA says his office withdrew a felony count of receiving stolen property against David's wife, Anne Earls earlier this month.
